|The present form will have to be completed and signed upon arrival. Non completion of this form will prevent you from boarding the research vessel.
The undersigned hereby agrees to abide by the rules and regulations issued by the « White Shark Trust for Research and Conservation », by the research team and associated organizations. The undersigned also confirms to have read and understood the « Rules and Regulations » form.
The following paragraph is optional and will not count against you for the approval of your application as cage diving will be optional and occasional: I hereby certify that I have followed a diving course organized by a recognized international diving association (PADI, CMAS, BSAC, etc), and succeeded and achieved both practical and theroetical exams for at least the first scuba diving level (PADI Open Water, CMAS One Star, etc.). I hereby acknowledge my entire responsibility in that matter and will not pursue any complaint, nor sue nor pursue any legal settlements against the « White Shark Trust » and/or against the chartered commercial white shark cage diving company, and their respective permanent and/or temporary staff members (including and more specifically the Divemaster in charge of the diving operations). I hereby waive all my rights regarding that matter. I further certify that I have no lung disease (e.g. Asthma). I further understand that my participation in the White Shark Trust Field Research Assistantship does not under any circumstances guarantee any scuba diving and/or cage diving.
I am aware and fully understand that field work and research, shark research, scuba diving, cage diving, shark diving and boat activities are potentially hazardous and very dangerous activities, and I am voluntarily participating in these activities with full knowledge of the danger involved and hereby agree and accept any and all risks of injury and death.
I allow the « White Shark Trust for Research and Conservation » and the « South African Collaborative White Shark Research Programme » to use, sell and/or publish any photograph / video / film footage that shows me in whole or part for any purpose. There will not be any further arrangements on that matter, nor any financial payment and/or contribution from our part should the picture (motion or still) be published, used and/or sold for other purposes.
I understand that the fee paid is only for transport, room and board. The paid fee constitutes a donation to the White Shark Trust. That fee does not cover or pay anything related to the research and/or the field work. Weather and sea conditions permitting, the « White Shark Trust » will conduct between 10 and 20 trips to sea per month on average. I understand that working in the marine environment, unexpected material damage or failure can occur which would also limit the number of days spent at sea. I further understand and accept that the paid fee will, under no circumstance, be refunded in part or in whole. There is absolutely no guarantee that we will have a certain number of sea trips per month.
I also understand that the « Rules and Regulations » sheet, displayed in the living area and handed out with this liability agreement upon arrival, are to be followed. Not confirming to these rules and regulations could lead me to be expulsed from the programme without any further claims or rights, and without prior warning. I understand that I am responsible for any damage caused to the house utilities and furniture, as well as all the other equipement used in the house and on the boat, and will pay for any damage and/or pay for replacing any damaged and/or lost item.
I presently have health and accident insurance in force which is valid in South Africa. Therefore, any medical condition arising during the programme will be paid for by my own health insurance policy. I affirm that the « White Shark Trust » will not be liable for any medical payments on my behalf. The undersigned agrees to be restricted and limited from pursuing any liability claims of whatever nature regarding injuries or illnesses sustained while participating in any of the organisation’s program. However, any and all other non-liability action or claim must be filed and pursued only in South Africa under the laws in state. Furthermore, I hereby certify that I am not under the influence of alcohol or any illegal drugs.
I further understand that by signing this document, I hereby release, waive, discharge and covenant not to sue the following:
The « White Shark Trust », its founders, its Trust Board Members, its members, its employees, its assistants, its volunteers, its researchers, its associated researchers, its agents, its sponsors, its temporary and/or permanent staff, Tracey-Lea SCHOLL, Michael C.SCHOLL, families, heirs and offices, participants, advertisers, promoters, sanctioning organization, or any subdivision thereof, owners, leasees of premises to conduct the activities and/or for the housing, their employees and officers, released from all liability from the undersigned, his personal representatives, heirs, and next of kins
for any and all loss or damage, personal injury, property damage and any claim or demands therefore on account of injury to the person or property or resulting death of the undersigned, while the undersigned is in or upon restricted areas, harbour, boats (in particular, but not restricted to, the research vessel « Lamnidae » MBM 1337) and/or on property (in particular, but not restricted to, the property at Strand Street 6 in 7220 Gansbaai) and/or any transportation vehicle used (in particular, but not restricted to, the Toyota Landcruiser CEM6948 and the VW Golf Chico CA57565), belongings, involving or surrounding the « White Shark Trust » and the housing located at the residential address of Strand Street 6 in Gansbaai.
The undersigned also understands that any activity undertaken under the guidance of the programme leader(s) and/or the « White Shark Trust », or more importantly, undertaken on my own, whether a one-day or multiple-day trip, will be on my own risk(s). I understand that I will temporarily not be part of this programme any more when I go on excursion/holiday trips not organised by the programme.
The fee for the return transport from Cape Town to Gansbaai, room and board will be set annually. The undersigned understands that this fee is considered to be a donation to the White Shark Trust and Field Research Assistantship program. This fee must be paid in full and for the whole assistantship period (unless a written eMail aggreement exists between the applicant and the White Shark Trust) no later than 60 days before the start of the assistantship. Cancellations prior to this 60-day deadline are accepted without cancellation fee. Cancellations between 30 and 59 days before the start of the assistantship will be charged a penalty of 75%. Cancellations done less than 30 days before the start of the assistantship will not include any refund. Cancellations due to illness, accident or extraordinary events require a written statement and a letter from the doctor (if applicable), and the assistantship will be postponed to another period suitable to both parties. We have to be very strict on this matter, as we get many applications and cannot take every applicant.
I have read this form and fully understand its content. By voluntarily signing this release and waiver of liability and indemnity agreement form, I am giving up all legal rights that I have. I further agree that no oral representations, statements or inducements apart from the foregoing written agreement have been made.
I herewith agree and fully understand that no scientific data or information acquired during my stay in South Africa while assisting as a Field Research Assistant for Michael Scholl and/or the « White Shark Trust » and/or the « South African Collaborative White Shark Research Programme » may be published, duplicated in any form (photocopy, copy, electronic, transfer, etc.), rendered public or used for any personal or academic use without the prior written permission of Michael C. Scholl.
I understand that this information has been collected for different research and scientific projects run by Michael Scholl, the White Shark Trust and associated organizations. I hereby decline any rights towards any of the data and/or information collected during my assistantship and stay in South Africa.
I have read this form and fully understand its content. By voluntarily signing this copyright agreement form, I am giving up all legal rights that I have and waive all rights towards any of the data collected or analyzed. I further agree that no oral representations, statements or inducements apart from the foregoing written agreement have been made.
I understand that I will work on a 6 meter (21 foot) BOAT to assist in the fieldwork. I further understand that the working / sea conditions can be uncomfortable and rough at times. ONLY apply if you feel comfortable with these conditions - But rest assured that the crew will always minimise risks and avoid dangerous conditions to the best of their abilities.
